Rebate Terms and Conditions

Terms and Conditions

  1. You must have reached the age of majority in your province which is required to be able to enter into a legally binding contract.
  2. Your home must not be currently listed for sale with a real estate brokerage.
  3. The property you are considering purchasing or selling must be located in Canada.
  4. Not valid on: rentals, transactions involving referral fees to other agents, transactions where another agent not part of the HomeFrog network is procuring the cause of sale or if you are a real estate agent.
  5. If you are selling a property, you must be the owner registered on title.
  6. You must obtain pre-approved mortgage financing and provide the pre-approval letter to your HomeFrog network agent before scheduling any property viewings.
  7. You must inform us if your contact information (phone/email/mail address) changes.
  8. Your HomeFrog network agent must act as the sole and exclusive agent for the purchase of real estate which must be validated in writing by signing a Buyer Agency Agreement.
  9. If you choose to use a real estate agent that is not a member of the HomeFrog network, then you will not be eligible to receive a rebate cheque from us.
  10. We must contact the HomeFrog network agent first on your behalf before you make any contact with them in order for you to qualify for the rebate program.
  11. For new construction purchases, your HomeFrog network agent must first meet you and register you at the builder’s sales office.
  12. The HomeFrog rebate program cannot be combined with other offers available from your HomeFrog network agent or the brokerage they are employed with, unless specifically authorized by the HomeFrog network agent or their brokerage.
  13. You must allow your HomeFrog network agent to schedule buyer appointments to visit specific properties listed for sale.
  14. Before visiting an open house, attempt to call or email your HomeFrog network agent to provide notification of the intended visit. If this is not possible, be sure to inform your agent of the visit as soon as possible thereafter.
  15. If you make any form of first contact with the builder/developer , in-house broker or Listing Broker in the form of registering on builder websites, telephone contact, email, personal visits and the like, the builder or Listing Broker can deny the payment of the commission; in such case you may not receive a rebate. To avoid this problem, every time you want to see a property on your own (for example at an open house) let the Listing broker/agent know that you are already represented by an agent and give them one of your HomeFrog network agent’s business cards.
  16. Notify your HomeFrog network agent when an offer is to be made on a specific property listed for sale. Your agent will prepare the offer and coordinate presentation of the contract to the listing broker/agent or their authourized representative.
  17. The commission rebate can only be paid to a named party of the transaction listed in the HomeFrog online registration; no third party can receive the commission rebate.
  18. All parties to a transaction are collectively entitled to a single rebate for the property they are purchasing or selling.
  19. Commission refunds or rebates assume that the listing broker is paying both the seller and buyer side brokerage commission.
  20. Rebate is payable and due only if closing occurs on a home listed on the rebate certificate and only if we receive the commission from the Brokerage representing you and after all terms, conditions and requirements of this program have been met.
  21. For any reason if the buyer or seller/builder cancels (terminates) the purchase agreement then the rebate will be not be paid out.
  22. All parties to the purchase transaction agree that if no commission is paid to us by the Brokerage representing you, then this agreement becomes null and void and this rebate is thereby voided.
  23. If the listing brokerage or builder offers a bonus above the commission , then this bonus will be included in the gross commission to the buying brokeage from which the rebate will be calculated.
  24. The rebate is based on the actual dollars received by us when the purchase closes and is funded; the GST and the $350 HomeFrog fee will be deducted from the actual dollars received in order to arrive at the amount of your rebate.
  25. For new homes and condos, the rebate is based on the base price of the home/condo purchase which does not include lot premiums, upgrades and options.
  26. We will receive a commission from the Brokerage identified on the certificate on the sale of any home purchased or sold through the plan. The Brokerage must deliver the commission to us at closing; A portion of this commission will be used to fund the rebate. We will issue the rebate once funds have cleared our banking institution.
  27. We strongly encourage all prospective home buyers or sellers to seek appropriate legal counsel for all aspects of a home purchase or sale transaction.
  28. We are not a party to and shall in no way be involved in the real estate contract between Builder/Seller and the Home Buyer.
  29. Builders/Sellers or real estate brokerages are not permitted to give undocumented cash to home buyers.
  30. We make no representation regarding the tax treatment of the rebate. No taxes except GST/HST will be withheld from payment. Please consult your qualified tax advisor for more information.
  31. We make no representations or warranties of any kind with respect to the Builder or Seller, the home constructed or to be constructed by Builder, the quality of construction, the value of the residence to be constructed by the builder or any other aspect of the real estate transaction between Builder/Seller and the home buyer, such transaction being a transaction solely between Home buyer and Builder/Seller. We are not responsible for any warranties, statements or covenants the Builder/Seller has expressed or implied.
  32. The HomeFrog website (www.HomeFrog.ca) terms and conditions are herby incorporated in all documents and the information contained in the website and the use thereof, and the terms of eligibility for the participants in the HomeFrog rebate program are expressly subject to the terms, conditions, waivers and qualifications set forth in such legal page.
  33. Offer is subject to limitations, exclusions, modifications and/or discontinuation without notice.
  34. Reading about our services and rebate offer online does not entitle you to a rebate from the builder or Brokerage representing you if you have not registered online on the HomeFrog.ca website and fulfilled the conditions set forth.
  35. By clicking on “I agree” you consent to the release of your personal information for the purposes as defined and outlined in our Privacy Policy.
